No. eXp Realty's revenue share is generated from actual real estate transactions with buyers and sellers, not from fees agents pay each other or purchases required to participate. That distinction is the entire legal difference between a pyramid scheme and a legitimate business, so it's worth walking through exactly how eXp holds up against it.
What Actually Makes Something a Pyramid Scheme
This isn't a matter of opinion, there's an actual legal test. Courts and the FTC generally apply what's known as the Koscot test, and it comes down to 2 questions: does the business require participants to pay for the right to sell something, and does it pay rewards that are unrelated to the sale of any real product or service, based instead on recruiting others into the program?
A scheme fails that test when people are compensated primarily for the money other people pay to join, not for a product or service actually being sold to an end customer. That's also why pyramid schemes inevitably collapse: eventually there aren't enough new recruits left to pay the people above them, and the FTC estimates roughly 89% of participants in a collapsed pyramid scheme never recoup what they put in.
Where eXp's Revenue Actually Comes From
Apply that test to eXp directly. Joining costs $149, the same kind of standard onboarding fee any brokerage charges, not an investment whose return depends on recruiting anyone. Nothing about that fee generates revenue share for anyone.
Revenue share itself comes from company dollar, the 20% eXp retains from a non-capped agent's commission on an actual closed real estate transaction, a home sale to a buyer or seller. If a sponsored agent never closes a deal, their sponsor earns nothing from them, ever. There's no membership fee, no required monthly purchase, and no product agents buy from each other to stay qualified. The entire pool is funded by actual production in the real estate market, not by agents paying other agents.
Every Brokerage Has a Hierarchy. That's Not What's in Question.
It's worth naming directly: every brokerage in the country has some form of hierarchy, a broker owner or franchise owner who profits from the production of the agents underneath them. That's true at eXp, at Keller Williams, at any traditional brokerage. What's actually different about eXp isn't the existence of a hierarchy, it's who gets to participate in the upside of it. At most brokerages, that revenue stays with the owner or franchise investors. At eXp, agents themselves get the opportunity to share in it, funded the exact same way, from those same transactions.

You Don't Have to Recruit Anyone to Make Money Here
Most eXp agents never build a revenue share organization at all, and that's not a failure of the system, it's how it's actually used. The large majority of agents at eXp are here purely to sell real estate on standard commission, the same as at any brokerage, with no requirement to ever sponsor anyone. Revenue share is available to every agent, but it's optional, not the thing you're required to chase to make this work for you.
The Bottom Line
A pyramid scheme depends on recruitment itself, funded by fees participants pay each other, with no real product changing hands. eXp's revenue share depends entirely on actual homes being bought and sold, funded by eXp's own retained commission on those transactions, available to agents who want to build it and entirely optional for those who don't. Those aren't 2 versions of the same thing wearing different names, they're structurally different by the actual legal definition.
If you're weighing eXp against other brokerages and want to understand how the model actually works beyond this one objection, that's exactly the kind of thing worth a conversation. herdteam.com is a good place to start that.
